EU: upload of the draft regulation on the protection of private data

The draft regulation adopted on the 25th comes along a communication entitled: “Safeguarding Privacy in a Connected World: A European Data Protection Framework for the 21st Century” which points to the need to guarantee a high level of data protection to increase consumer trust in online services and thus fulfill the potential of the digital economy.  The proposed regulation aims to provide a single set of rules applying directly throughout the Union.  Concerning individuals, the Commission suggests imposing their explicit consent in the framework of data processing and give web users the right to be digitally forgotten and the right to data portability.  The proposal also aims to reduce administrative burdens for businesses whose activities include processing personal data and increase the responsibility of people in charge of processing it.  Finally, the draft provides for penalties up to 2 percent of the global annual turnover of an enterprise if it bends the rules.  For this, the rate will be graduated: 0.5 percent of global sales if the company charges an individual for a request concerning their data, 1 percent if a company refuses to provide data or fails to right erroneous information, and 2 percent for more severe offenses.
