France: a general smoking ban in public places

A decree of November 15th, 2006 follows the commitment of the Prime minister (see our article ref. 061014) to pursue the fight against tobacco addiction by insuring a ban on smoking in places devoted to a collective use. The ban will come into force on February 1st, 2007. Coffees-shops, tobacconists, restaurants, dance halls and game rooms will have until January 1st, 2008. (Ref 061161)

As from February 1st, 2007, it will be forbidden to smoke « in all closed and covered places which receive the public or that constitute workplaces ».

Smoking areas. Firms – with certain exceptions for places receiving young persons, old persons or sick people- will be allowed to install special dedicated areas for smokers. These will have to be « closed rooms, affected to tobacco consumption and in which no service whatsoever is provided. No task of maintenance or service can take place there,
