France : the employer is responsible even without an offence in case of moral harassment

The employer is responsible for the moral harassment schemes committed in his company, even if he did not committed any offence. This is what decided the Court of Cassation in an order that should encourage people to more prevention. (Réf. 06661)

In an order of June 21st 2006, the Court of Cassation decided that the employer is responsible for the moral harassment acts committed within his company, even « in absence of offence from him ». The case concerned the head of an association who had subjected various moral harassment acts such as threats, denigration or unjustified punishments. The court of Cassation decided in the employees’ favour who called for damages from the head but also from the association itself.
