Spain: for the first time, judges assess the moral harm affecting discriminated pregnant women

The high court of justice of Catalonia granted an indemnity of 30 600 euros to a woman laid off when she came back from her maternity leave. The court considered that there was a proof of discrimination based on her « gender and linked to her pregnancy and motherhood » and ordered her return within the firm. It is the first time that a Spanish court recognizes and quantifies the moral damage linked to a situation of harassment and tension within the firm. (Ref. 06979)

The plaintiff had asked for 60 236 euros, an amount the court cut by half : 20 000 euros were granted to repair the moral harm, as the court considered that the good evolution of her pregnancy was « harmed by an unfair attack to her dignity », and 10 000 euros were granted to compensate the psychological harm for unjustified dismissal. The victim had been treated for anxiety and depression. Finally, 600 additional euros will refund the plaintiff’s lawyer fees.
