Spain: new measures for effective equality at work and to combat discrimination

Approved by the Spanish Parliament on 12 July 2022, Law 15/2022, the Integral Law for Equal Treatment and Non-Discrimination places new obligations on employers requiring them to review their employment selection and access mechanisms, their working conditions, professional promotion and modes of remuneration, so as to ensure equality and non-discrimination among employees, to protect any potential victims, and to compensate for any damages suffered.

Law 15/2022 recognizes the right to equal treatment, non-discrimination and dignity of persons, regardless of nationality, racial or ethnic origin, religion, sexual orientation or identity, gender expression, state of health or genetic predisposition to suffer from a disease. It also establishes that neither illness nor its therapy may justify differences in treatment, within the limits of possible public health obligations or objective limitations to the exercise of certain activities.
