The directive on temporary work, adopted on November 19, 2008, was published in the Official Journal of the European Union on December 5. In this dispatch, we are explaining the provisions of this text which must be transposed into Member States' legal systems by December 5, 2011. (Ref. 080986)
Principle of equal treatment from the first day. Aimed at establishing a protective framework for temporary agency workers, the main measure of this directive is the introduction of the principle according to which “the basic working and employment conditions of temporary agency workers shall be, for the duration of their assignment at a user undertaking, at least those that would apply if they had been recruited directly by that undertaking to occupy the same job.” These “basic working and employment conditions” are established by binding standards (legal, statutory, conventional) in force in the user undertaking and related to pay, work duration, overtime, breaks, resting time, night work, paid leaves and public holidays.
