Czech Republic: a bill on discriminations to comply with the Community law

The Czech legislation on equal treatment and protection against discrimination is heterogeneous and fragmented. Indeed, the Labour Code generally prohibits any form of discrimination in labour relations. However, it does not define any terms concerning discrimination. So the bill aims at complying with the Community law in a matter of equal treatment. There are four EU proceedings in the area of equal treatment filed due to the non-fulfilment of implementing duties. The European Commission is claiming particularly that the Czech parliament has not transposed into Czech law the principles of equal treatment for men and women in the social security system, has an inadequate definition of discrimination, and has insufficiently implemented the provisions concerning difference in treatment on the basis of age. The draft Antidiscrimination Act is conceived as a piece of legislation whose aim is to ensure equal opportunities, protect against discrimination, ensure equal access for all people in all the defined areas, including employment, regardless of race, ethnic origin, nationality, gender, disability, sexual orientation, age, religion or faith and world-view.
