The Ecuadorian Constituent Assembly adopted, on April 30, 2008, a series of drastic measures to fight staff exploitation and job precariousness. The reform of labor law outlaws agency workers during the recruitment process, the outsourcing of professional performances, as well as part-time work paid by the hour. (Ref. 080363)
The text voted by the legislator cancels
the so-called “tercerización”, that is outsourcing on the employment
market. The Constituent Assembly (which is temporarily replacing the congress
until presentation of the new Ecuadorian constitution), nonetheless excluded certain
services from this prohibition: safety, surveillance and cleaning services, the
catering industry and messaging.
