Based on the observation that “the effectiveness of transnational information is currently lacking, since the European works council is not informed and consulted enough in the event of mergers”, the draft directive, which can still be amended in the framework of the inter-services consultation, mainly aims at ensuring that EWCs can play their full part in anticipating and accompanying change, develop a genuine transnational social dialogue. To that end, it thus aims at ensuring the effectiveness of employees’ transnational information and consultation rights, strengthening legal certainty and ensuring a better link between the legislative instruments on information and consultation. In that perspective, the preliminary draft provides for the following:
