EU: analysis of the preliminary draft revision of the EWC directive

The preliminary draft revision of the EWC directive is currently in inter-services consultation at the European Commission. This document, of which Planet Labor managed to get a copy, is in line with the three objectives to ensure the effectiveness of transnational information and consultation rights, to remedy the lack of legal certainty in some situations, such as mergers or takeovers and to ensure a better link between the different levels of staff representation. Based on the observation that “the effectiveness of transnational information is currently lacking, since the European works council is not informed and consulted enough in the event of mergers”, the draft directive, which can still be amended in the framework of the inter-services consultation, mainly aims at ensuring that EWCs can play their full part in anticipating and accompanying change, develop a genuine transnational social dialogue.
