EU: European Commission withdraws draft regulation on the balance between collective action and the free provision of services

Yellow card.  The possibility for national assemblies to have the Commission review its text is a part of the Lisbon Treaty which came into force in December 2009.  So this is a first.  The draft regulation was supposed to be an answer to the concerns resulting from the jurisprudence of the European Court of Justice which, in a series of decrees (see our dispatches No.  071012 and 071034), gave precedence to the freedom of establishment and the free provision of services over the right to take collective action.  The European Commission’s text did not determine which one prevailed but put them on a same level.
