The law on the modernization of the labor market transposes into labor legislation the provisions of the identically named agreement signed on January 21, 2008 by the employers’organizations and four of the five union confederations (CFDT, CFE-CGC, CFTC and FO). Most of the clauses in the agreement (see our article n°080030) ask the government, as well as the social partners at the cross-industry of branch level, to take the necessary measures to implement this agreement. The objective of the legislator is to respect the balance of the agreement between the social partners, which is the first to introduce a “flexibility-security” approach on the labor market.
