France: interview of Claire Toumieux, partner at Flichy Grangé Avocats, about the obligation to use French in employment relations

Claire Toumieux.  This ruling was rendered against an EDS France company which recruited a senior account manager – i.e. a senior executive – with a employment contract which provided that the amount of the bonus was contingent on individual objectives and that it could amount to up to 40% of his basic salary.  Since the objectives were defined in English, the employee claimed that they were not opposable to him and that he should therefore perceive the maximum amount provided for in the labor contract.  The Court gave him satisfaction on the basis of article L.1321-6 of the Labor Code which provides that all documents containing obligations for the employees or provisions needed for the performance of their work should be written in French.
