In a decision rendered on January 15, 2009, the Supreme Court cancelled the sentence for defamation of four former employees who, in an email to the customers of their former company, described irregularity committed by the latter vis-à-vis their employees. The Supreme Court linked employees' "right to criticism" and journalists' "right to inform." (Ref. 090073)
After their employer told his customers about the termination of the labor contracts of these four employees, the latter sent an email to answer the customers’ question as to these reasons for the termination of their work relation with their employer.
