In a ruling of June 15, the Court of Justice of the European Communities (CJEC), supplemented its jurisprudence on the mobility of patients by limiting the right to refund of costs linked to hospital care. Only "accommodation and meal expenses" are to be refunded. (Ref. 06610)
In this case, a Spanish patient, seriously sick and admitted to emergencies in a hospital of his country, asked to be able to go to France, which was more adapted to his health. He received an authorization and could go to France for medical treatment. His social security system dealt with the cost of hospital treatment. But it refused to refund his traveling, accommodation and meal expenses and those of the family member who had accompanied him because of his poor health.
