Great Britain: the main changes in the new transfer of undertakings regulation

The amendment of the Transfer of Undertakings, Protection of Employment Regulations: TUPE, dating from1981, came into force last April 6. In accordance with the Community legislation that it completes to implement, this new law aims at ensuring the protection of employment contracts within a transfer of undertakings context. It also clarifies the former laws' provisions. (Ref. 06797)

The TUPE regulations preserve continuity of employment contracts in case of transfer of undertakings and protect employees from dismissal or any modification of the terms and conditions of employment. This amendment introduces some innovations made necessary by the practice. The principal modifications are :

  • A widening of the scope of the Regulations scope to service provision situations: the new regulations provide expressly that employment contracts must be maintained in the event of service
