Spain: unions reject flexible hours demanded by superstores

Employers launched consultation period.  A few days ago, the national court issued a ruling giving unions satisfaction and forcing superstores to recognize the right to weekly rest, at the rate of at least 5 free weekends a year for all employees working more than 4 days a week, as provided for in the sector’s collective agreement (see our dispatch No.  120408).  However, the ruling could be obsolete before it even applies because the new labor law, permanently approved on June 28 (see our dispatch No.  120435), gives businesses the possibility of amending employees’ working conditions even without the consent of their representatives.  Indeed, unions claim that Carrefour, Auchan, Leroy Merlin or Media Markt have already started to let WC representatives know about their intentions.  They have opened the consultation period provided for in new Article 41 of the Status of Workers.
